Read about your (SUP) exercise of extended producer responsibility

In the latest issue of the magazine Energy and Recycling, Przemysław Kuna, Managing Director at Interzero, together with Konrad Nowakowski from PIOIRO, commented on the SUP directive, which has a direct impact on ROP.

The transposition of legal provisions on reducing the impact of certain plastic products on the environment is undoubtedly a major challenge for entrepreneurs. Restrictions on activities, the obligation to label packaging and additional fees are just a few examples of the impact of the draft act.

The introduced list of disposable products that are prohibited from being placed on the market is constantly growing. You can find items such as: cotton buds, straws, cutlery, plates, containers for food and drinks made of expanded polystyrene. Fishing gear has also joined the products covered by extended producer responsibility.

The purpose of the legal changes is to improve the environmental situation of the country and, consequently, to impose many new obligations on entrepreneurs, such as reporting, recording, additional fees and achieving minimum collection levels.

We encourage you to read the article on the share of recyclate in the introduced packaging in the latest issue of the bi-monthly magazine Tworzywa Sztuczne w Przemyśl, in which Paweł Sosnowski, Management Board Representative for Environmental Regulations, Interzero mentions the Single Use Plastics Directive and the draft regulation on packaging and packaging waste.

The share of recyclate will be calculated as an average of beverage bottles for which such a share will be required, placed on the market in a given year. The directive therefore does not require the share of recyclate in each introduced bottle. Mandatory recyclate in beverage bottles is an important step in creating a circular economy. - recalls Pawel Sosnowski.

The new regulations will therefore be a great challenge for those introducing products in packaging, but also for the recycling industry. They will improve the quality of recyclate, where the quality is currently insufficient, but will also force further investments in recycling installations that will ensure that the demand for recyclate is covered at least at the level of the required shares in packaging. A big challenge will be to provide recyclate that will meet the stringent requirements for its use in the production of packaging sensitive to contact. -

Entrepreneur: BDO entry fee only until the end of February

We would like to remind you that according to Article 57 of the Waste Act (Journal of Laws 2013 item 21 as amended), entrepreneurs registered in the BDO register are obliged to pay an annual fee for maintaining their entry in the BDO register for a given year by the end of February.

Only entrepreneurs are subject to the registration and annual fee:

    • introducing batteries or accumulators,

    • introducing electrical and electronic equipment and authorised representatives,

    • producer, importer and intra-Community buyer of packaging,

    • introducing vehicles,

    • introducing products in packaging into the territory of the country,

    • introducing tires into the territory of the country,

    • introducing lubricating oils into the territory of the country.




    • The annual fee must be paid to the account of the marshal's office responsible for the company's registered office or place of residence. Account numbers can be found on the websites of the authorities.
      The annual fee is respectively:
      PLN 100 - for micro-entrepreneurs
      300 zł - for other entrepreneurs

      Attention! The annual fee is not paid in the year in which the registration fee was paid.

      Failure to pay the annual fee may result in removal from the register and the inability to continue operations.

First of all, work on the draft act on limiting the use of single-use plastic products is nearing completion. It is a transposition of the provisions of the directive commonly referred to as single use plastics (SUP). These regulations are likely to enter into force at the turn of the first and second quarters of this year. Companies introducing selected types of single-use plastic products will have the greatest impact. - said Pawel Sosnowski

In addition to the directive regulating SUP, it is worth considering the deposit system that will come into force in Poland from 2025.

The premise of the act is to leave as much freedom to entrepreneurs as possible in creating a deposit-refund system. The boundary conditions included in the draft assume, however, that the system is to cover the entire country and is to be open to all entrepreneurs introducing products in packaging covered by the deposit and commercial entities that will want to join it. - convinces Pawel Sosnowski
