Authorised representative of the manufacturer in Slovenia - FAQ

According to the Slovenian EPR legislation, not only the actual producer (manufacturer) of the goods, but also any entrepreneur who introduces products or packaging covered by the EPR legislation onto the Slovenian market for the first time is considered a producer. A manufacturer is therefore an entity that manufactures, sells (also online), packages, imports or makes intra-Community deliveries of products and packaging regulated by the EPR.

Slovenian extended producer responsibility regulations cover:

  • packaging (unit, bulk, transport),
  • equipment electrical and electronic,
  • batteries and accumulators,
  • candles,
  • products covered by the provisions of the Directive SUP (Single-use plastics) and fishing gear.

Entities placing these goods on the Slovenian market must comply with the obligations under the EPR regulations. Importantly, only foreign producers of packaging and electrical equipment are obliged to establish an authorised representative. For other categories of goods, it is not necessary to have an authorised EPR representative.

The authorised representative is a legal entity established in Slovenia that assumes the responsibilities of a foreign entity (entities) arising from the Slovenian extended producer liability legislation.

The obligation to appoint an authorised manufacturer's representative for the EPR results from the from several pieces of EU legislation and from local legislation based on them.

These community acts include:

  • Directive 94/62 on packaging and packaging waste,
  • Directive 2008/98 on waste,
  • Directive 2012/19/EU on waste electrical and electronic equipment (WEEE).

Slovenian legislation making it mandatory to have an authorised representative in Slovakia includes:

  • Environmental Protection Act ZVO-2,
  • Regulation on packaging and packaging waste (UL RS št. 54/21, 208/21, 44/22 ZVO 2, 120/22),
  • Waste Regulation (UL RS št. 77/22, 113/23, 13/25),
  • Regulation on waste electrical and electronic equipment (UL RS št. 55/15, 47/16, 72/18, 84/18 ZIURKOE 108/20, 44/22 ZVO-2).

Having an authorised EPR representative in Slovenia is intended to ensure that foreign operators on the Slovenian market correctly fulfil all obligations under the Extended Producer Responsibility legislation.

Yes. The obligation to establish an authorised representative does not apply only to Slovenian companies and businesses that have a registered address in Slovenia and a Slovenian tax number (VAT). Subsidiaries usually do not fulfil these conditions, therefore companies with subsidiaries in Slovenia are obliged to establish an authorised representative for the EPR.

The manufacturer's authorised representative in Slovenia may be a legal entity established in Slovenia (Slovenian VAT number) and will enter into an appropriate agreement with the foreign manufacturer, whereby it will assume all of that manufacturer's obligations under Slovenian EPR regulations.

Not. Currently, there are no quantitative exemptions in Slovenia. This means that producers supplying even small quantities to the Slovenian market packaging, packaged products or electrical and electronic equipment are subject to all obligations under local regulations on extended producer liability.

Until 2021, producers introducing less than 15 tonnes of packaging into Slovenia per year were exempt from a number of obligations, including the packaging levy. In April 2021, the legislation was amended -. quantitative exemptions have been abolished and obliged all producers to comply with EPR obligations.
