An authorised representative for the EPR in Croatia is required to establish a all entities that:
- are not established in Croatia,
- as part of its activities place packaging, packaged products, electrical and electronic equipment or batteries and accumulators on the Croatian market,
- sell the above products to individual customers (natural persons) in Croatia by means of distance selling (e.g. online shops, teleshopping, telephone orders, e-mail, etc.).
Operating in contravention of the EPR can result in a severe fine!
The obligation to establish an authorised representative in Croatia stems from several national legal acts:
- Packaging and packaging products - Regulations on packaging and packaging waste, single-use plastic products and fishing gear containing plastics (OG 137/23),
- batteries and accumulators, electrical and electronic equipment - Regulation on the management of specific categories of waste in the Fund system (OG 124/23),
- general provisions - the Waste Management Act (OG 84/21, 142/23).
The EPR regulations in Croatia and other Member States were introduced in implementation of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives.
According to the definition in Croatian EPR legislation, a producer is an entity (natural or legal person) that develops, produces, processes, sells, imports or places on the market in the Republic of Croatia packaging, packaged products, electrical and electronic equipment or batteries and accumulators.
Importantly, the manufacturer is considered to be only an entity that sells products to natural persons (consumers, Croatian citizens). If you sell your products exclusively to Croatian entrepreneurs, you are not subject to the obligations under the EPR and do not need to establish an authorised representative of your company in Croatia.
The online platform (marketplace) through which distributors introduce products and packaging to the Croatian market is also considered to be a Producer. If individual distributors do not comply with their legal obligations under the EPR regulations and do not register themselves with the Extended Producer Responsibility Register (hr. Registar proizvođača s proširenom odgovornošću, RPPO), it is the online platform that must take over their ERP responsibilities in Croatia.
