The legislation was enacted in 2022 and the <strong>from 2024, many companies will have to submit annual ESG reports<\/strong> developed in accordance with the European Sustainability Reporting Standards, the so-called ESRS.<\/p>\n<p>The non-financial ESG reporting obligation already applies to almost 4,000 Polish companies. In the following years, it will be systematically expanded according to the schedule below:<\/p>\n<ul>\n<li>From 2024, so-called public interest companies with revenues of more than EUR 50 million and employing min. 500 people,<\/li>\n<li><strong>from 2025, all large companies or parent companies of large groups <\/strong>meeting at least 2 of the following criteria: revenues min. EUR 50 million, more than 250 employees, balance sheet total min. EUR 25 million,<\/li>\n<li>from 2026 onwards, medium and small listed companies meeting a minimum of 2 of the following criteria: balance sheet total min. EUR 5 million and revenue min. EUR 10 million for small companies or balance sheet total min. EUR 25 million and revenue min. They are the basis for ratings and non-financial assessments of companies, countries and other organisations (e.g. NGOs).<\/p>\n<p>The individual ESG indicators and the overall ESG assessment of a company make it possible to check whether and to what extent an organisation is committed to sustainability, implements socially responsible business practices and brings benefits (mainly non-financial) to all its stakeholders. The analysis of a company's ESG strategy and reports are an important element in the assessment of a company's risks, carried out, for example, in M&amp;A processes, by investors and, increasingly, by a company's potential counterparties.<\/p>\n<\/div><\/div><\/div><\/div><div class=\"panel panel-default wpb_accordion_section group  no-block-padding\"><div class=\"panel-heading wpb_accordion_header ui-accordion-header\"><p class=\"panel-title font-weight- text-   icon-size-rg\"><a data-toggle=\"collapse\" data-parent=\"#accordion_580630107\" href=\"#1670599046-2-20\"><span>What is an ESG report?<\/span><\/a><\/p><\/div><div id=\"1670599046-2-20\" class=\"panel-collapse collapse\"><div class=\"panel-body wpb_accordion_content ui-accordion-content half-internal-gutter single-block-padding\">\n\t\t\t\t\t\t<div class=\"uncode_text_column\" ><p>An ESG report is an annual, non-financial report that provides information on a company's activities in 3 areas: environmental, social and corporate governance, and on the results of the activities carried out. A properly structured ESG report should be based on the guidelines contained in a number of legal acts (national, European and international), and organisational acts that include, among others:<\/p>\n<ul>\n<li>Accounting Act implementing the Directive on disclosure of non-financial information,<\/li>\n<li>Non-Financial Disclosure Directive (NFRD\/CSRD),<\/li>\n<li>Financial Services Sustainability Disclosure Regulation (SFDR)<\/li>\n<li>EU Taxonomy Regulation,<\/li>\n<li>recommendations of the Task Force on Climate-related Financial Disclosures (TCFD).<\/li>\n<\/ul>\n<p>\n<\/div><\/div><\/div><\/div><div class=\"panel panel-default wpb_accordion_section group  no-block-padding\"><div class=\"panel-heading wpb_accordion_header ui-accordion-header\"><p class=\"panel-title font-weight- text-   icon-size-rg\"><a data-toggle=\"collapse\" data-parent=\"#accordion_580630107\" href=\"#1670600043182-2-8\"><span>When will ESG reporting become mandatory?<\/span><\/a><\/p><\/div><div id=\"1670600043182-2-8\" class=\"panel-collapse collapse\"><div class=\"panel-body wpb_accordion_content ui-accordion-content half-internal-gutter single-block-padding\">\n\t\t\t\t\t\t<div class=\"uncode_text_column\" ><p>The ESG reporting obligation entered into force on 1 January 2024. From this date, almost 4,000 Polish companies have to submit annual mandatory non-financial reports. In the following years, the ESG reporting obligation will be extended to more and smaller entities operating in the EU.<\/p>\n<\/div><\/div><\/div><\/div><div class=\"panel panel-default wpb_accordion_section group  no-block-padding\"><div class=\"panel-heading wpb_accordion_header ui-accordion-header\"><p class=\"panel-title font-weight- text-   icon-size-rg\"><a data-toggle=\"collapse\" data-parent=\"#accordion_580630107\" href=\"#1670600075613-3-1\"><span>Who is affected by the ESG reporting obligation?<\/span><\/a><\/p><\/div><div id=\"1670600075613-3-1\" class=\"panel-collapse collapse\"><div class=\"panel-body wpb_accordion_content ui-accordion-content half-internal-gutter single-block-padding\">\n\t\t\t\t\t\t<div class=\"uncode_text_column\" ><p>From 2024 onwards, the non-financial ESG reporting obligation extended to large companies, so-called public interest entities or parent companies of large groups with more than 500 employees and meeting one of the following criteria: net turnover of more than EUR 40 million and\/or total assets of more than EUR 20 million.<\/p>\n<p>In the following years, the non-financial reporting obligation will also extend to smaller entities:<\/p>\n<ul>\n<li>from 2025 onwards, large entities or parent companies of large groups meeting two of the following criteria: more than 250 employees, net turnover of more than EUR 50 million, total assets of more than EUR 25 million,<\/li>\n<li>from 2026, small and medium-sized EU-listed entities meeting two of the following criteria:\n<ul>\n<li>for medium-sized companies: more than 10 employees, net turnover of more than EUR 50 million, total assets of more than EUR 25 million,<\/li>\n<li>for small companies: more than 10 employees, net turnover of more than EUR 10 million, total assets of more than EUR 5 million (postponable until 2028),<\/li>\n<\/ul>\n<\/li>\n<li>from 2028, certain non-EU entities with a net turnover in the EU of more than EUR 150 million and with an EU branch with a net turnover of more than EUR 40 million or an EU subsidiary subject to the
